Since Hardin represented Andy Pettitte for a period during last year, McNamee’s lawyers have also asked to the judge to remove Hardin from the case. Pettitte was also guilty of using performance enhancing drugs. However, Hardin has not considered this argument. According to him, he will be continuing to represent Clemens and also, he will be filing a response to this motion with the court.

Presently, the FBI, as per the request of the Congress, is investigating whether Clemens committed perjury under sworn testimony.
